Pending legislation — women's age to 21
The Prohibition of Child Marriage (Amendment) Bill seeks to raise the women's minimum age to 21. As of early 2026 it has not been passed in both houses of Parliament. If passed, the new minimum will apply to all subsequent marriages. Check current status before planning if you are a woman currently below 21.
What if you're under the minimum age
Marriage performed below the minimum age is voidable — the child / younger partner can seek annulment within 2 years of attaining the legal age. The marriage is also a criminal offence under the Prohibition of Child Marriage Act, with penalties for adults involved (parents, officials).
Why the minimum exists
Three reasons: (1) maturity and consent — adults should be able to consent to lifelong commitment; (2) education and economic readiness — minimum age helps complete education and reach financial autonomy; (3) health — reduces health risks of early childbearing for women. The 21-women's-age proposal aligns gender equity with the existing men's minimum.
Are there exceptions
Generally no — the minimums apply across personal-law acts and Special Marriage Act. Some communities historically allowed earlier marriage under custom but the Prohibition of Child Marriage Act 2006 overrides custom for marriage age.
